NVC To Initiate Immigrant Visa Processing Based on Chart B Cut-Off Dates for EB-5 Categories

It’s become apparent that a majority of mainland Chinese born EB-5 investors can no longer access the National Visa Center (NVC) website to pay visa fees, access DS-260 applications, among others tasks. The most recent visa bulletin moved the EB-5 Chart B for China backwards, causing the confusion. The updated bulletin shows that the Chart B priority date for mainland-born EB-5 investors is now June 14, 2014 and earlier; NVC indicated that cases with priority dates later than the aforementioned one would not undergo processing at this time.

As the visa bulletin is updated monthly, NVC will continue to contact applicants whose priority date is before Chart B’s date for filing. NVC also indicated that in regards to applicants who previously filed materials but no longer can due to Chart B cut-off dates, NVC will issue confirmation notices upon receiving applications and materials.

Finally, the State Department recently announced that by the Spring of 2017, a brand new visa portal will be available to applicants. Here, applicants can manage visa fees, DS-260 submissions, case statuses, and other important procedures.
